By engaging our services or using our website, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.


1. Services Provided

SolarBiz Development Experts specializes in online business development for solar companies, including:

  • Web Design & Development – Custom website design, development, and optimization
  • Search Engine Optimization (SEO) – Improving your visibility in search results and driving organic traffic
  • Email Marketing – Strategy, campaign creation, and automation to nurture leads and drive conversions

Our services are specifically tailored for solar installation companies operating in the United States market.


2. Payment Terms

2.1 Payment Structure

Projects follow a 50/50 payment split:

  • 50% Deposit – Due upon contract signing to commence work
  • 50% Final Payment – Due upon project completion and site launch

All payments must be received before work begins or before the final site goes live.

2.2 Accepted Payment Methods

We accept:

  • Electronic bank transfer (EFT)
  • International wire transfer (Swift)
  • Credit/debit card payments (processing fees may apply)

All prices are quoted in US Dollars (USD) unless otherwise specified.

2.3 Late Payments

Final payment must be received within 7 days of project completion notification. Late payments may result in:

  • Suspension of website hosting or services
  • Late fees of 2% per month on outstanding balances
  • Legal action to recover unpaid amounts plus collection costs

2.4 Refund Policy

Deposit Refunds:

  • Deposits are non-refundable once work has commenced
  • If we cancel the project due to our inability to deliver, deposits will be refunded in full
  • Client cancellations after work has begun forfeit the deposit

Final Payment Refunds:

  • If you are dissatisfied with the completed project, we will work with you to make necessary revisions within the original scope
  • Refunds on final payment are not provided once the website has been delivered and approved
  • Our 90-Day Growth Guarantee (Section 5) provides additional protection for your investment

3. Project Timeline and Delivery

3.1 Standard Timeline

Typical project completion: 30-60 days from contract signing and deposit receipt.

Actual timeline depends on:

  • Project complexity and scope
  • Timely client feedback and content provision
  • Third-party integrations or dependencies

3.2 Client Responsibilities

To meet project timelines, clients must provide:

  • Access to necessary accounts (hosting, domain, email platforms, etc.)
  • Content, images, branding materials within 7 days of request
  • Feedback on designs and drafts within 5 business days
  • Final approval for launch within 3 business days of completion notice

3.3 Delays

Delays caused by client non-responsiveness or failure to provide required materials may extend the timeline. We are not liable for delays outside our control.

Projects paused for more than 30 days due to client inaction may incur a reactivation fee or be considered abandoned.


4. Intellectual Property Rights

4.1 Client Ownership

Upon receipt of final payment, you own:

  • The final website design and code
  • Content you provided or that we created specifically for your project
  • Your company branding, logos, and materials

4.2 SolarBiz Ownership

We retain ownership of:

  • Our proprietary frameworks, tools, and methodologies
  • Template structures and reusable components
  • Our business processes and strategies

4.3 Portfolio Rights

We reserve the right to:

  • Display your website in our portfolio
  • Use your project as a case study (with your permission)
  • Reference your company as a client

If you require confidentiality, please notify us in writing.

4.4 Third-Party Assets

Some projects may include licensed third-party elements (fonts, stock photos, plugins). You are responsible for maintaining these licenses after project completion.


5. Guarantees and Warranties

5.1 90-Day Growth Guarantee

We guarantee measurable traffic and lead growth within 90 days of your website launch. If you don’t see results:

  • We will optimize your site at no additional cost
  • We will continue working until you achieve measurable growth
  • “Measurable growth” is defined as a minimum 25% increase in website traffic or qualified leads compared to your pre-launch baseline

Guarantee Conditions:

This guarantee applies only if:

  • Your website remains live and accessible
  • You follow our recommended SEO and content strategies
  • You maintain active email marketing campaigns as advised
  • You provide accurate baseline metrics before launch
  • You don’t make unauthorized changes that negatively impact SEO

Guarantee Exclusions:

This guarantee does not cover:

  • Market conditions beyond our control (economic downturn, regulatory changes, etc.)
  • Competitor actions or market saturation
  • Client failure to implement recommended strategies
  • Force majeure events (natural disasters, pandemics, government restrictions)

5.2 Dedicated Support Guarantee

We provide ongoing expert support for:

  • Technical fixes and bug resolution
  • Minor updates and adjustments
  • Guidance on site management

Support is provided during business hours (Monday-Friday, 9 AM – 5 PM EST) with response within 24-48 hours for non-emergency issues.

Support Exclusions:

Major redesigns, new features, or significant content updates are considered new projects and quoted separately.

5.3 Website Functionality Warranty

We warrant that your website will:

  • Function as designed on modern browsers (Chrome, Firefox, Safari, Edge)
  • Be mobile-responsive
  • Be free from major bugs at launch

This warranty covers 30 days post-launch for bugs or functionality issues present at delivery.


6. Disclaimers and Limitations

6.1 Results Disclaimer

IMPORTANT: While we are confident in our strategies and provide our 90-Day Growth Guarantee, individual results vary.

The growth projections, calculators, and estimates on our website (including the 2026 Solar Business Growth Calculator) are:

  • Based on industry averages and our experience
  • For illustrative purposes only
  • NOT guarantees of specific revenue, profit, or installation numbers
  • Dependent on numerous factors outside our control

We make no warranty that you will achieve any specific financial results. Your success depends on your market, competition, pricing, service quality, sales process, and countless other variables.

6.2 Third-Party Services

We may integrate third-party services (hosting providers, email platforms, payment processors, etc.). We are not responsible for:

  • Third-party service outages or failures
  • Changes to third-party pricing or terms
  • Data breaches at third-party providers
  • Third-party policy violations

6.3 SEO Disclaimer

Search engine optimization results depend on constantly changing algorithms. While we follow best practices:

  • We cannot guarantee specific search rankings
  • Rankings may fluctuate over time
  • Competitor actions may impact your visibility
  • Search engines may change algorithms without notice

6.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Our total liability for any claim arising from our services is limited to the total amount you paid us for the specific project in question.

We are not liable for:

  • Lost profits, revenue, or business opportunities
  • Indirect, incidental, or consequential damages
  • Third-party claims
  • Force majeure events

This limitation applies regardless of the legal theory (contract, tort, negligence, etc.).


7. Client Responsibilities and Cooperation

7.1 Accurate Information

You agree to provide:

  • Accurate business information
  • Legal rights to all content, images, and materials provided
  • Truthful representation of your services and credentials

You are responsible for ensuring your website content complies with:

  • All applicable laws and regulations
  • Industry-specific advertising requirements
  • FTC guidelines for testimonials and claims
  • Privacy laws (GDPR, CCPA, etc.)

We provide technical implementation but are not responsible for legal compliance of your business practices or claims.

7.3 Content Accuracy

You are responsible for the accuracy of:

  • Product/service descriptions
  • Pricing information
  • Company credentials and certifications
  • Customer testimonials and reviews

8. Confidentiality

8.1 Mutual Confidentiality

Both parties agree to keep confidential:

  • Business strategies and plans
  • Pricing information
  • Proprietary processes
  • Customer data

8.2 Exceptions

Confidentiality does not apply to information that:

  • Is publicly available
  • Was known before disclosure
  • Is required by law to be disclosed

9. Termination

9.1 Client Termination

You may terminate the project at any time by providing written notice. Upon termination:

  • You forfeit the deposit
  • You pay for all work completed to date
  • We will provide work-in-progress files upon payment of outstanding balances

9.2 Our Termination Rights

We may terminate the agreement if:

  • You fail to pay invoices
  • You fail to provide required materials after 30 days
  • You engage in abusive or unethical behavior toward our team
  • You request illegal or unethical services

9.3 Post-Termination

Upon termination:

  • All outstanding invoices become immediately due
  • We may remove the website from our servers if hosting through us
  • Each party returns or destroys confidential information

10. Ongoing Services and Hosting

10.1 Optional Hosting

If we provide hosting services:

  • Monthly/annual fees apply as agreed
  • We may increase fees with 30 days notice
  • You may cancel hosting services with 30 days notice
  • We are not responsible for backing up your site after handover (unless specifically contracted)

10.2 Maintenance Plans

Optional maintenance plans are available for:

  • Security updates
  • Plugin/software updates
  • Content updates
  • Technical support

11. Data Protection and Privacy

11.1 Data Collection

We collect personal information necessary to provide our services:

  • Name, email, phone, company details
  • Website analytics and performance data
  • Payment information (processed securely through third parties)

11.2 Data Usage

We use your information to:

  • Deliver our services
  • Communicate about your project
  • Send optional marketing communications (with consent)
  • Improve our services

11.3 Data Security

We implement reasonable security measures to protect your data. However, no system is 100% secure, and we cannot guarantee absolute security.

12. Indemnification

You agree to indemnify and hold harmless SolarBiz Development Experts from any claims, damages, or expenses arising from:

  • Your breach of these terms
  • Your website content or business practices
  • Your violation of laws or third-party rights
  • Your use of the website after handover

13. Dispute Resolution

13.1 Governing Law

These terms are governed by the laws of the Republic of South Africa, regardless of where the client is located.

13.2 Dispute Process

Before pursuing legal action, both parties agree to:

  1. Communicate concerns in writing
  2. Attempt good-faith negotiation for 30 days
  3. Consider mediation if negotiation fails

13.3 Jurisdiction

Any legal action must be brought in the courts of Durban, KwaZulu-Natal, South Africa.

13.4 Attorney Fees

The prevailing party in any legal dispute is entitled to recover reasonable attorney fees and costs.


14. Force Majeure

Neither party is liable for failure to perform due to circumstances beyond reasonable control, including:

  • Natural disasters
  • War, terrorism, or civil unrest
  • Government actions or restrictions
  • Pandemics or public health emergencies
  • Internet or utility failures
  • Acts of God

Performance obligations are suspended during force majeure events and resume when circumstances permit.


15. General Provisions

15.1 Entire Agreement

These Terms and Conditions, together with any signed contracts or proposals, constitute the entire agreement between parties and supersede all prior discussions or agreements.

15.2 Amendments

We may update these terms at any time. Continued use of our services after changes constitutes acceptance. Material changes will be communicated to active clients.

15.3 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

15.4 Waiver

Failure to enforce any provision does not waive our right to enforce it later.

15.5 Assignment

You may not assign this agreement without our written consent. We may assign our rights and obligations to a successor business.

15.6 Independent Contractors

We are independent contractors, not employees, partners, or agents of your company.
